Terms and Conditions – SPORF x Social Media Music Survey

  1. Competition
    1. The Competition is promoted by [SOCIAL CHAIN AG] [127, Portland Street M1 4PZ] (“Social Chain“) and is subject to these Terms and Conditions stated below (“Terms“).
    2. Each person who enters the Competition accepts and agrees to comply with and abide by these Terms and the decisions of Social Chain, which shall be final and binding with respect to all aspects of the Competition. 
    3. The Competition opens at [[00:00] on [17/02/21] and closes at [23.59] on [24/02/21]]. Entries received after that date shall not be entered into the Competition. 
  2. Entries and Eligibility
    1. Entries to the Competition may only be made by anyone meeting each of the following requirements:
      1. [must have a valid email address and sign up to our newsletter],
      2. [must fill in all the information requested in the entry form]; 
      3. must be aged 16 or over and must be a resident of mainland Great Britain (England, Scotland and Wales), and
      4. must be eligible to enter under these Terms (“Entrant”).
  1. The following are not eligible to participate: 
    1. employees of Social Chain and their immediate families and anyone professionally connected with the Competition;
    2. employees of any company responsible for redemption of prizes/vouchers or for supplying prizes for the Competition and their respective franchisees, subsidiaries, agents and advisors; 
    3. other persons assisting with this Competition; 
    4. any person not being an individual natural person; 
    5. any syndicate or collection of persons acting in concert; and 
    6. any person entering via an agent or using the services of or which is an entity carrying on the business of entering (or advising on entering) prize promotions.
  2. All entries must be made directly by the person entering the Competition. Entries made using methods such as a computer macro, a script or the use of automated devices or processes are not allowed and all such entries will be disqualified.
  3. How to Enter
    1. On completion of the survey the entrant must provide a valid email address and agree to the relevant terms and conditions, for the chance to win a prize]. 
    2. To enter the Competition, Entrants must:
      1. fill in the information requested in the entry form
      2. otherwise complying with any other eligibility and entry requirements mentioned in these Terms.
  1. Incomplete, invalid or illegible entries will be declared void by Social Chain.
  2. There is a limit of one entry per person.
  3. No purchase or payment of any kind is necessary to enter or win.
  4. Social Chain will not accept any responsibility for technical or other difficulties in entering or any entries that are delayed or corrupted.  
  5. Entrants are responsible for all costs and expenses relating to participation in the Competition, such as the cost of accessing the internet. If using a computer and/or internet-access not owned or paid for by the entrant, the entrant is reminded to get the owner’s permission before entering. 
  6. Social Chain reserves the right to exclude any entries which it believes to be fraudulent or based on misconduct, or if, in its reasonable opinion, it considers that there is a significant risk that the Entrant may bring the Social Chain brand into disrepute.
  7. Nothing in the Terms shall affect any Entrant’s statutory rights. Social Chain may (in its sole discretion) decline to enter into any correspondence as otherwise stated in the Terms.
  1. Winners
    1. All valid entries received during the Competition will be collected together and sorted into the draws for the prize.
    2. The Winner will be drawn during the Entry Period. [The entries will be drawn at random under independent supervision via a computer programme producing a verifiably random result.]
    3. One winner will be announced in each prize draw. The winner will be announced on [28/02/21].
    4. [Reserves may also be drawn (provided that this shall not imply any obligation upon Social Chain to re-award any prize-claim that has lapsed or become void for any reason).]
    5. Social Chain shall not be obliged to contact unsuccessful entrants.
    6. The winners will be notified directly via email. If a winner fails to confirm receipt of such notification within 24 hours of being notified as a winner, Social Chain reserves the right (in its sole discretion) to forfeit the prize or award to an alternatively drawn winner.
  2. The Prize
    1. The prize for the Competition comprises of a voucher for Amazon.co.uk with a balance of 150.00GBP provided by Social Chain for the Winner. Social Chain reserves the right to substitute the prize with a prize of equal or greater value.
    2. Prizes may not be exchanged, encashed or transferred. 
    3. In order to claim their prize, any winner may be asked for identification that matches their entry details. Social Chain reserves the right to validate any claim and may ask for proof of identity and/or address and/or age.
    4. Prizes may not be exchanged for any cash or other alternative, are not transferable, assignable, divisible, permitted to be sold or resold and are not for use in conjunction with any other promotion or offer. Prizes cannot be replaced or refunded in the event of loss, theft or missed opportunity.
    5. Social Chain reserves the right to change the specification advertised in the event that supervening circumstances make this necessary.
    6. Social Chain may increase the Competition prize pool, but shall not be obliged to.
  3. Responsibility
    1. To the fullest extent permitted by applicable law (but not otherwise) Social Chain and its agents assume no responsibility and are not liable for (i) the accuracy or otherwise of the prize description or illustration, (ii) any representation, warranty, condition or guarantee in respect of a prize (other than those warranties or conditions implied by statute and which cannot be excluded), (iii) the non-availability, loss, late or non- receipt, damage, illegibility or non-readability of a prize notification or other communication sent in connection with this Competition, (iv) verifying whether the person awarded a prize is the person entitled to claim that prize, and (v) any taxes, fees, charges or other costs which winners may be required to pay any time in connection with a prize, (save to the extent that Social Chain has expressly and specifically accepted responsibility on the Entrants property). Nothing in these terms and conditions will limit the Social Chain’s liability for death or personal injury caused by its negligence or for fraud.
    2. Please note that no association is to be implied by this Competition, the prize-pool or any arrangements in relation to prize-fulfilment.
  4. Privacy
    1. Please see here details of our privacy notice applying to this Competition. 
    2. Please note: selected partners of Social Chain and/or 3rd parties (depending upon the nature of the prize and whether in addition to or in place of an entrant providing personal data to Social Chain) may require entrants to provide to any such partner or 3rd party personal-data in connection with claiming/redeeming prizes and (for prizes which are vouchers) any products or services of partners or 3rd parties which are to be redeemed using prize-vouchers, so entrants should satisfy themselves with the privacy policies of such partners and 3rd parties, as Social Chain cannot accept any responsibility for them.

  5. Ownership of Competition Entries and Intellectual Property Rights
    1. You agree that Social Chain may, but is not required to, make your entry available on its website and any other media, whether now known or invented in the future, and in connection with any publicity of the competition. You agree to grant Social Chain a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry and any accompanying materials for such purposes.
  6. General
    1. Social Chain may: (i) extend any time limit or waive any of the Terms where a person might otherwise have been disqualified (without obliging Social Chain to relax the Terms on any further occasion for that Entrant or at all for any other person); (ii) terminate, extend or suspend the Competition at any time where this is necessary or desirable due to supervening circumstances beyond Social Chain’s control; and (iii) substitute a product deemed to be an appropriate replacement and of equal or greater value in the place of any of the prizes (or any part of a prize to the extent divisible). Social Chain’s decision in the exercise or interpretation of any of its rights or discretions in connection with these Terms shall be final and binding and no correspondence shall be entered into. 
    2. Social Chain reserves the right at its absolute discretion to disqualify Entrants that do not comply with these Terms or the spirit thereof or any Entrant who it reasonably believes has interfered with the fair running of the Competition.
    3. All age limits shall be deemed to be actual age as at the time of acceptance of the Terms, unless expressly stated otherwise in these Terms.
    4. These Terms shall be exclusively governed by and construed in accordance with the laws of England and the courts of England and Wales will have exclusive jurisdiction in the event of any dispute arising in connection with the Competition or these Terms.
